The Two-Year Deadline for Enforcing a Court Judgment in China — and What Happens If You Miss It

过了两年,还能申请强制执行吗?——申请执行时效六问

What if the losing party still refuses to perform after a court judgment takes effect? The winning party may apply to the people's court for compulsory enforcement. But the right to apply is subject to a time limit: if more than two years have passed, is enforcement still possible? This article explains the rules under the current Civil Procedure Law (2023 Revision) and the relevant judicial interpretations.

01 — How long is the period for applying for enforcement?

Two years. Article 250 of the Civil Procedure Law provides: “The period for applying for enforcement is two years.”

02 — When does the two-year period start to run?

The same Article 250 provides: “The period prescribed in the preceding paragraph shall be calculated from the last day of the performance period specified in the legal instrument; where the legal instrument specifies performance in installments, it shall be calculated from the date on which the performance period of the final installment expires; where the legal instrument specifies no performance period, it shall be calculated from the date on which the legal instrument takes effect.”

In short: if the instrument states a performance period, the clock runs from its expiry; for installment performance, from the expiry of the final installment; if no period is stated, from the date the instrument takes effect.

03 — Do suspension and interruption rules apply to the two years?

Yes. Article 250 of the Civil Procedure Law also provides: “The suspension and interruption of the time limit for applying for enforcement shall be governed by the legal provisions on the suspension and interruption of limitation periods.” For example, if during the last six months of the period the right cannot be exercised because of force majeure or other obstacles, the period is suspended and continues to run once the obstacle is removed.

04 — Is applying to the court the only way to interrupt the period?

No. The Supreme People's Court's Interpretation on enforcement procedures provides that the time limit for applying for enforcement is interrupted by any of the following: an application for enforcement is filed; the parties reach a settlement agreement; or one party demands performance or agrees to perform the obligation. Upon interruption, the period is calculated anew.

In other words, demanding performance from the person subject to enforcement (a dunning demand) within the two years interrupts the period — there is no need to apply to the court first. Practice note: make sure the demand leaves a trail — use a delivery-tracked mailing, or keep written records such as WeChat messages or emails, because the right holder bears the burden of proving the interrupting event.

05 — Can I still apply after the two-year period has expired?

Yes — the application may still be filed, and the court must accept it. Article 481 of the Interpretation of the Civil Procedure Law provides: “Where an applicant applies for enforcement after the time limit for applying for enforcement has expired, the people's court shall accept the application. If the person subject to enforcement raises an objection to the time limit and the people's court finds the objection established upon review, it shall rule against enforcement. If, after the person subject to enforcement has performed all or part of the obligation, that person requests reversal of enforcement on the ground of not knowing that the time limit had expired, the people's court shall not support the request.”

Two points stand out. First, the court does not examine the time limit on its own initiative: if the person subject to enforcement raises no objection, enforcement proceeds as normal. Second, performance already rendered cannot be clawed back on the ground that the performer did not know the period had expired.

06 — If the court rules against enforcement, are there other remedies?

Expiry of the period extinguishes only the right to apply for compulsory enforcement; the substantive claim does not disappear — it becomes a “natural obligation”. Two paths remain worth considering:

(1) A fresh action based on a new agreement. A reply letter of the Enforcement Office of the Supreme People's Court concerning overdue enforcement applications resulting from settlement agreements points out that, where enforcement is applied for beyond the statutory period, the creditor may demand payment from the debtor on its own, or bring an action before a people's court with jurisdiction “on the ground of non-performance of a repayment agreement”. So if the creditor can obtain an expression of willingness by the person subject to enforcement to perform, and preserve it as evidence, or reach a new repayment agreement, and the other party then fails to perform on time, the creditor may sue on that new agreement. Note: the fresh action rests on the new agreement, not on the original judgment itself.

(2) Set-off of debts. Article 568 of the Civil Code provides: “Where the parties owe each other debts and the subject matter of the debts is of the same kind and quality, either party may set off its own debt against the due debt of the other party, except where set-off is not permitted by the nature of the debt, by agreement of the parties, or by provisions of law. A party asserting set-off shall notify the other party, and the notice shall take effect upon arrival. Set-off may not be subject to any condition or time limit.” Accordingly, where the parties owe each other due debts of the same kind, the right holder may notify the other party of set-off — set-off asserts the substantive claim and is generally unaffected by expiry of the enforcement application period; whether it is established still depends on the statutory conditions (mutual debts due, subject matter of the same kind and quality) and on case-by-case review.

The enforcement application period is only two years, its starting point is fixed, and the remedies after expiry are roundabout. Once a judgment takes effect, apply for enforcement as early as possible; if you hold off, demand performance periodically and keep the evidence, so the period is interrupted and starts afresh — rather than letting a hard-won judgment lapse into a mere “natural obligation”.

判决生效后,义务人仍不履行,权利人可以向人民法院申请强制执行。但申请执行有期间限制:超过两年,是不是就执行不了了?本文依据现行《民事诉讼法》(2023 年修正)及相关司法解释,逐一说明。

01 申请执行的期间有多久?

两年。《民事诉讼法》第二百五十条规定:“申请执行的期间为二年。”

02 两年期间从何时起算?

同样是第二百五十条:“前款规定的期间,从法律文书规定履行期间的最后一日起计算;法律文书规定分期履行的,从最后一期履行期限届满之日起计算;法律文书未规定履行期间的,从法律文书生效之日起计算。”

简言之:文书写明履行期限的,从期限届满起算;分期履行的,从最后一期届满起算;没写履行期间的,从文书生效之日起算。

03 这两年适用时效中止、中断吗?

适用。《民事诉讼法》第二百五十条同时规定:“申请执行时效的中止、中断,适用法律有关诉讼时效中止、中断的规定。”例如,在时效期间最后六个月内因不可抗力等障碍不能行使权利的,时效中止,障碍消除后继续计算。

04 只有向法院申请执行才构成中断吗?

不是。《最高人民法院关于适用〈中华人民共和国民事诉讼法〉执行程序若干问题的解释》规定,申请执行时效因下列事由中断:申请执行、当事人双方达成和解协议、当事人一方提出履行要求或者同意履行义务。从中断时起,时效期间重新计算。

也就是说,在两年内向被执行人提出履行要求(催告)即可中断时效,不必非要先去法院申请执行。实务提示:催告务必留痕——使用可查询签收的邮寄方式,或保留微信、邮件等书面记录,日后由权利人对中断事由承担举证责任。

05 已经超过两年,还能向法院申请执行吗?

可以申请,法院应予受理。《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第四百八十一条规定:“申请执行人超过申请执行时效期间向人民法院申请强制执行的,人民法院应予受理。被执行人对申请执行时效期间提出异议,人民法院经审查异议成立的,裁定不予执行。被执行人履行全部或者部分义务后,又以不知道申请执行时效期间届满为由请求执行回转的,人民法院不予支持。”

要点有二:一是法院不主动审查时效,被执行人不提异议,执行照常进行;二是被执行人已经履行的,不能再以“不知道时效届满”为由要求执行回转。

06 法院裁定不予执行后,还有其他救济途径吗?

时效届满消灭的只是强制执行的申请权,实体债权并不消灭,该债权成为“自然债”。仍有两条路径可以考虑:

(1)凭新协议另行起诉。《最高人民法院执行办公室关于如何处理因当事人达成和解协议致使逾期申请执行问题的复函》指出,超过法定期限申请执行的,债权人可自行向债务人索取,也可“以不履行还款协议为由”向有管辖权的人民法院提起诉讼。因此,若能取得被执行人愿意履行的意思表示并固定为证据,或者与对方达成新的还款协议,对方到期不履行的,可以就该新协议另行起诉。注意:另行起诉的依据是新协议,而非原判决本身。

(2)债务抵销。《民法典》第五百六十八条规定:“当事人互负债务,该债务的标的物种类、品质相同的,任何一方可以将自己的债务与对方的到期债务抵销;但是,根据债务性质、按照当事人约定或者依照法律规定不得抵销的除外。当事人主张抵销的,应当通知对方。通知自到达对方时生效。抵销不得附条件或者附期限。”据此,在双方互负到期、同种类债务的情况下,权利人可以通知对方抵销——抵销主张的是实体债权,一般不因申请执行时效届满而受影响;是否成立,仍需满足互负债务到期、标的物种类品质相同等法定条件,并以个案审查为准。

申请执行时效只有两年,且起算点明确、过期后救济迂回。判决生效后,权利人应尽早申请强制执行;暂不申请的,也应定期催告并留存证据,使时效中断、重新计算,避免胜诉判决变成一纸“自然债”。
